1. Introductory provisions and consent
- Application: GatherApp mobile application serving as an interactive map for connecting people and sharing leisure activities.
- Provider: swhouse s.r.o., ID No.: 29563160, registered office: plukovníka Mráze 1190/10, 102 00, Praha 10 – Hostivař.
- By creating an account in the Application you express your unconditional agreement with these Terms. If you do not agree, you must not use the Application.
2. Age restriction and user account
- The Application is strictly restricted to persons over 18 years of age. By creating an account you solemnly declare that you meet this requirement.
- You are fully responsible for the confidentiality of your login credentials and for all activities that occur under your account.
3. Rights and obligations of the user (Rules of conduct)
The user undertakes to use the Application responsibly, in accordance with applicable laws of the Czech Republic, good morals and these Terms.
Accuracy of data and identity
- The user is obliged to provide only true and accurate information when registering and creating a profile.
- It is strictly prohibited to create fake profiles, impersonate another person or animal, or in any way deceive other users about your identity or age.
Organisation of events
- The user who creates an event in the Application bears full legal and factual responsibility for its conduct, safety and lawfulness.
- The user undertakes not to organise events on private land without the owner's consent, in protected landscape areas in violation of their rules, or in dangerous locations.
- If the nature of the event requires a special permit, it is the organiser's obligation to obtain it.
Personal safety and respect for others
- The user is obliged to take care of their own safety when meeting strangers. We recommend organising first meetings in public places.
- Any form of stalking, threatening, bullying or inappropriate sexual behaviour will result in immediate account suspension and possible referral to law enforcement authorities.
Prohibited content
- It is strictly prohibited to upload content or create events promoting violence, racial or other hatred, pornography, the provision of sexual services, the use or sale of illegal substances, weapons and any unlawful conduct.
- It is prohibited to misuse the Application for commercial purposes, spreading spam or unsolicited advertising without prior agreement.
4. Moderation and reporting of users
- Reporting system: Users may report the behaviour of other users within the Application if they believe they are violating these Terms.
- Right to inspect content: In the event of a report, the user expressly consents to the provider reviewing the relevant text communication for the purpose of investigating the incident.
- Sanctions: The provider reserves the right to immediately and without notice delete harmful content or permanently delete a user's account. The provider's decision is final.
5. Disclaimer (IMPORTANT NOTICE)
The following disclaimers apply to the maximum extent permitted by applicable law.
- Status as a technology platform: GatherApp operates exclusively as a passive intermediary service (virtual notice board/map). The provider does not create, organise, approve or verify physical events created by users.
- Absence of user vetting: The provider does not conduct any criminal background checks on users nor does it verify the identity of users beyond standard registration on a blanket basis. Meeting other users in the real world is entirely at your own risk.
- Property and non-property damage: The provider bears no responsibility for any property damage, theft, injury, harm to health, psychological harm or death occurring in direct or indirect connection with the use of the Application or participation in an event created in the Application.
- Accuracy of information and cancellation of events: The provider is not responsible for the truthfulness of information stated in event details. The provider bears no responsibility for situations where the organiser fails to attend the event or the event is cancelled. Users have no right to compensation for travel or other costs related to participation.
- Disputes between users: The provider does not act as arbitrator or mediator. In the event of any dispute between you and another user, you expressly waive any claims and rights to compensation against the provider.
- Map data: The Application uses geographic data from third parties. The provider does not guarantee their accuracy. The user must assess entry into a specific location with regard to the current physical and safety situation.
6. Premium features and payment terms
- Purchase of Premium services: The Application may offer the option to purchase additional features ("Premium") through one-time payments or regular subscriptions via In-App Purchases.
- Subscription and automatic renewal: If you choose a subscription, it will automatically renew at the end of each billing period at the same price until you cancel it.
- Cancellation of subscription (Important!): You must cancel the subscription through your account settings in the Apple App Store or Google Play, no later than 24 hours before the end of the current billing period. Deleting your GatherApp user account or uninstalling the Application from your phone does not automatically cancel the subscription.
- Exception to the right of withdrawal: Since Premium represents digital content that is not supplied on a tangible medium and the service is made available to you immediately upon completion of the transaction, you expressly agree that by starting to use the premium features you lose the right to withdraw from the contract within 14 days without giving a reason.
- Refunds: All payments for In-App Purchases are processed through the Apple App Store or Google Play and are subject to their respective refund policies. The provider does not provide pro-rata refunds for partially used subscription periods beyond those policies. After cancellation, Premium features will remain active until the end of the currently paid period. Direct refund requests to Apple App Store or Google Play.
- Price changes: The provider reserves the right to adjust the prices of premium services at any time. A change in subscription price will take effect from the next billing period and you will be notified in advance.
7. Availability of service
We do not guarantee 100% availability of the Application. The Application may be unavailable due to maintenance or outages. The provider is not responsible for any loss of data (e.g. chat history) or for damage caused by unavailability of the service. No compensation is provided for paid Premium features in the event of a service outage.
8. Final provisions
- These terms are governed by the law of the Czech Republic. All disputes shall be resolved by the competent courts of the Czech Republic.
- We reserve the right to unilaterally amend these terms at any time. Users will be notified of changes in the Application. By continuing to use the Application after the publication of changes you express your agreement with them.
- These terms take effect on 15 May 2026.
